Overtime Policies:
Michigan State University is covered by the Federal Fair Labor Standards Act (FLSA). The University is also covered by the Michigan Wage and Hour Act where applicable. Employees are considered either exempt or non-exempt from the FLSA’s coverage with respect to minimum wage and overtime. Overtime is defined under the FLSA as hours worked in excess of 40 during a single workweek.* Overtime must be paid at the rate of time-and-one-half for scheduled hours worked in excess of 40 in a work week for all non-exempt employees (CT, 1585*) and AP and APSA exempt employees, levels 8-11, per MSU’s collective bargaining agreements. AP and APSA employees, levels 12 and above, are not eligible for overtime pay. However, where unusual staffing and work requirements exist, the unit administrator may approve compensatory time off equal to the number of overtime hours worked. All University employees classified as non-exempt must accurately track and record their hours worked each day, as well as leave taken.
All paid overtime and compensatory time (earned and used) must be reported in the HR/Payroll system through the EBS portal. To record compensatory time earned, departments should enter only the number of actual hours worked. FLSA allows employees to accrue a maximum of 240 hours of compensatory time (which reflects 160 overtime hours worked). Departments may set a lower cap.
